The US Department of Education has initiated an investigation into Smith College, a private liberal arts college for women in Massachusetts, concerning its admissions policy that includes transgender women. The probe, announced on Monday by the department's Office for Civil Rights, will assess whether the college violates Title IX, a federal law enacted in 1972 that prohibits sex-based discrimination in educational programs receiving federal funding.
Title IX permits single-sex institutions, but the department argues that such status should be based on biological sex, not gender identity. Smith College, founded in 1871, has allowed transgender women to apply since 2015, aligning with several other women's colleges in the United States. Its current admissions policy states that any applicants who self-identify as women, including cisgender, transgender, and nonbinary women, are eligible for admission.
The investigation follows a complaint filed in June 2025 by the conservative group Defending Education. The group stated that it opposes discrimination on the basis of sex in educational institutions and that Smith College's policy undermines the intent of Title IX. The college's approach has been debated for years; in 2013, it drew attention when a transgender high school student was denied admission due to discrepancies between her gender identity and financial aid documents. According to the Women's College Coalition, the number of US colleges that admit transgender women has declined from over 200 to approximately 30 by 2023.

This investigation is part of a wider effort by President Donald Trump's administration, which has taken a firm stance on transgender rights. The administration argues that Title IX should restrict transgender women from accessing women's spaces, including sports teams. Earlier guidance issued under the Biden administration, which extended protections based on sexual orientation and gender identity, was invalidated by a federal judge in January 2025 due to legal issues.
Last year, Trump instructed 40 states to eliminate content focused on LGBTQ+ issues from federally funded sexual education materials, warning that noncompliance could result in loss of funding. These actions reflect a broader policy shift regarding transgender rights in education.
